1. This agreement
These terms are between you and MACROHUB LLC, which runs Apexevo ("we"). Before your account starts, the app asks you to agree to them and to theprivacy policy, and records the versions you agreed to. If you do not agree, please do not use Apexevo.
2. Who can use Apexevo
You need to be 18 or over. You agree to give honest answers about yourself, because the plan and its safety checks rest on them.
3. Not medical advice
Apexevo gives general fitness and nutrition guidance. It is not a medical device and does not diagnose, treat or prevent any condition. Its health screen looks for situations where general guidance could do harm, but it cannot know everything about you.
- Talk to a doctor before you start a new diet or exercise routine, especially if you have a health condition, take medicines, are pregnant or have been told to limit activity.
- Stop an exercise if it hurts, and get help if you feel chest pain, faintness or unusual breathlessness.
- Medicine reminders are an aid to memory. Your prescriber's instructions come first, and a reminder may be late or missed, for example when your phone is off or on silent.
- In an emergency, call your local emergency number.
4. Your account
Keep your password to yourself, and tell us if you think someone else has used your account. You are responsible for what happens under it.
5. A beta
Apexevo is in beta. Features will change, some will be added and some removed, and there will be mistakes to fix. Export your data from time to time if it matters to you. The beta is free.
6. Using it fairly
Please do not:
- try to reach anyone else's data, or get around the app's security;
- interfere with the service, overload it, or send automated requests to it;
- copy, resell or build a competing product from the app, its content or its code;
- use the contact, feedback or bug forms to send spam, abuse or anything unlawful.
7. Your data and our work
What you enter is yours. You allow us to store and process it only to run Apexevo for you, as the privacy policy describes, and you can export it at any time.
The app, this website, their design, the plan engine MuN and the exercise content belong toMACROHUB LLC. You may use them for your own, personal use while these terms apply.
8. Other services
Exercise demonstrations are played from YouTube, which has its own terms and privacy policy. Apexevo runs on Google Firebase and Cloudflare, and the app is delivered through Apple's App Store and Google Play, each under its own terms.
9. Ending your use
You can stop using Apexevo at any time and delete your account in Settings, Delete account, or ask us to do it for you. We may suspend or close an account that breaks these terms, and will tell you why unless the law or safety prevents it. We may end the service, and would give reasonable notice so you can export your data first.
10. Warranties and liability
Apexevo is provided as it is, during a beta and afterwards, without promises that it will be uninterrupted, free of mistakes or suitable for a particular purpose. To the extent the law allows, we are not liable for indirect or consequential losses, or for harm that comes from acting on general guidance against a doctor's advice. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer where you live.
11. Changes to these terms
If these terms change in a way that matters, their version number goes up, and the app asks you to read them and agree before you carry on. You can say no and sign out instead, and ask for your account to be deleted. The version and date at the top say which terms these are and when they last changed.
12. The law that applies
These terms are governed by the law of the place where MACROHUB LLC is registered. If you use Apexevo as a consumer, you also keep any protections the law where you live gives you and that cannot be set aside by agreement.
